Any discussion of Our "American" Social Construct of Six Elements begins with The Declaration of Independence.

Element One of Six that Form our Social Construct of "American" law is factually several separate legal items bundled together.
The context of the events leading up to this document especially the organic out-break of the revolutionary war is important, as these events influence the documents legal Form, its intent, and its textual content.
First the Legal Form of the document is that of an indenture. An indenture is a particular Form of agreement between two parties.
The document implicitly establishes the two Primary Parties, to wit, "the One People" who are united together as primary party one and primary party two, who is the indentured servant of "the One People", "the government". Both parties are present and identified.
"That all Men” (That's all humans, including women and children) "are created equal, that they are endowed by their Creator with certain unalienable Rights that among these are Life, Liberty and the pursuit of Happiness.” [This is a claim of "Legal Standing" as the Equal Popular Sovereign that all living citizens of "America" are presumptively claiming, are taking possession of, intend to use, and enjoy].
The Declaration of Independence implies and expresses “that to secure these rights, Governments are instituted among Men (and Women) “deriving their just powers from the consent of the governed.”
This is a clear expression of the Popular Sovereign Social Station that "the One People" are fighting to legally achieve.
Second. Element One is an offer to contract, to enter into an exchange, i.e. when the governed give their consent they accept in return ownership and interactive management authority as part of their role as the Equal Citizen "Boss" of this implied enterprise in self-governance. [This is what Plato defined as a social contract, this what it does, and this is how it works today in our lawful American Social Construct, our democracy.] To secure these rights... the ownership, dominion, and interactive participation of "the People".
The Declaration of Independence expresses “that whenever any form of ["American"] Government becomes destructive of these ends, it is the Right of the People [the "Body" of the equal citizen owner managers] to alter or to abolish it”. [This is the power of ownership expressed, implied, and defined. This text establishes in writing some of the limits of the absolute Popular Sovereignty of each Equal Citizen Owner with Management Authority and the limits of the absolute power of the United Group acting by certified vote to form consensus and act... ["to form a more perfect union"].
The Declaration of Independence expresses that “when a long train of abuses and usurpation's, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security".
The Declaration of Independence expresses that “We the People” can “institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to affect their Safety and Happiness.” [This is our Ownership and Management Authority as Equal Citizens defined even further.]
The Declaration of Independence is the first element of the American Social Construct organically written by the Founding Fathers and the Framers, and the Public to empower each successive generation including you, Gen 10; to inspire and motivate you to take action. But you must freely choose to claim this Social Station under law and then interactively fulfill the Social Station "Role" of Citizen Owner Manager, with the Lawful Authority to Express your Popular Sovereignty of "America" as a united non-violent community striving "to Form a more perfect union" for all "Americans".
Third. your inheritance of this "Life Estate" becomes a legislated promise and by original Federal law; a written promise can be enforced as a contract. This legislated promise/contract is not just written and legislated, it is the Supreme Law of the Land of the Free and the Home of the Brave thus, it is the 1st Generation's offer to you, because
your Life Estate as Citizen Owner Manager is this important to "America's" success; or its failure if you refuse to interactively fulfill your role as "the Boss" of this Enterprise of Self Governance.
However, the courts have said that the Declaration of Independence is not legally binding!

Is the Declaration of Independence an outstanding example of the spirit and intent of the law as opposed to the letter, of U.S. Law?
